These Terms of Service ("Terms") govern your access to and use of the website https://smryxellphodlarn.world (the "Site") and any orders you place for products offered by Smryxellphodlarn ("we", "us", "our"). By accessing the Site or submitting an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

These Terms are governed by the laws of New Zealand. Any disputes are subject to the non-exclusive jurisdiction of the courts of New Zealand.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable laws or regulations.
  • Impersonate or attempt to impersonate us, our employees, another user or any other person or entity.
  • Introduce viruses, malware or other harmful code, or attempt to gain unauthorised access to our systems or networks.
  • Use automated means (e.g. scrapers, bots) to access the Site without our prior written consent.
  • Collect or harvest personal data of other users or of us without consent.

We reserve the right to suspend or terminate your access to the Site if we reasonably believe you have breached these Terms.

3. Products and information

We offer VascoterraHerb for sale via the Site. Product descriptions, images and pricing are provided for information. We strive to ensure accuracy but do not warrant that product descriptions, imagery or other content are error-free. We reserve the right to correct errors and to change or discontinue products or prices without prior notice. Product packaging may vary; we do not guarantee that the packaging you receive will match images on the Site in every detail.

VascoterraHerb is a food supplement (dietary supplement). It is not a medicine and is not intended to diagnose, treat, cure or prevent any disease. Individual responses may vary. You should follow the instructions for use and, if you have a medical condition or take other medication, consult a healthcare professional before use.

4. Orders and contract formation

When you submit an order via the Site, you are making an offer to purchase the product(s) on the terms stated (including price and delivery). We are not obliged to accept your order. A contract between you and us is formed only when we confirm acceptance of your order (e.g. by email confirmation). We may refuse or cancel an order (for example due to stock, pricing errors, suspected fraud or breach of these Terms) and will notify you and refund any payment already made if we do so.

You are responsible for ensuring that the information you provide (name, email, address, phone if given) is accurate and complete. We are not responsible for delivery failures caused by incorrect details you supply.

5. Price and payment

Prices displayed on the Site are in New Zealand dollars (NZD) and include GST where applicable, unless otherwise stated. Delivery charges (if any) will be shown before you confirm the order. We reserve the right to change prices at any time; changes will not affect orders already accepted.

Payment is due as specified in the order process. We use secure payment methods. By providing payment details you represent that you are authorised to use them. We do not store full card details on our servers; payment processing may be handled by third-party payment providers subject to their terms and privacy policies.

6. Delivery

We will deliver the product to the address you provide, using the delivery method and timeframe indicated at checkout. Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers or events outside our reasonable control. Risk of loss and title pass to you upon delivery to the carrier. If delivery fails due to your fault (e.g. wrong address, no collection), we may charge you again for re-delivery or treat the order as cancelled in accordance with our Return Policy.

7. Returns and refunds

Our Return Policy applies to all purchases. You have the right to return unused products within the period and under the conditions set out there. Refunds will be processed in accordance with that policy and these Terms.

8. Intellectual property

All content on the Site (text, graphics, logos, images, layout and software) is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute or use any of this content for commercial purposes without our prior written consent. You may view and print one copy for personal, non-commercial use.

9. Limitation of liability

To the fullest extent permitted by law:

  • We do not exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded or limited by law.
  • We shall not be liable for any indirect, consequential, special or punitive loss or damage (including loss of profit, data or goodwill) arising from your use of the Site or any product, even if we have been advised of the possibility of such loss.
  • Our total liability to you in connection with any order or the Site shall not exceed the amount you paid us for the relevant product(s) in the twelve (12) months preceding the claim.

Nothing in these Terms affects your statutory rights as a consumer under New Zealand law (including the Consumer Guarantees Act 1993 where applicable).

10. Privacy and data

Your use of the Site and any order involve the processing of your personal data. This is described in our Privacy Policy and Cookie Policy. By using the Site and placing an order, you acknowledge that you have read and understood those policies.

11. General

If any part of these Terms is held to be invalid or unenforceable, the remaining provisions continue in effect. Our failure to enforce any right does not waive that right. These Terms (together with the Privacy Policy, Cookie Policy and Return Policy where referenced) constitute the entire agreement between you and us regarding the Site and orders.
